$1,100,000 Premises Liability
A 34 year old woman was shopping in a Wal-Mart store when an employee of Wal-Mart caused some plastic waste baskets on an upper shelf to fall onto our client. As a result of the merchandise falling, our client suffered an elbow (ulnar nerve) injury which required two surgeries. She then developed Reflex Sympathetic Dystrophy (RSD) which has caused her to lose much of the function of her left arm. When we received the case from another law firm, they had a $200,000 offer to settle shortly before trial.
When our firm took over, we hired two prominent experts to discuss her future damages. This additional preparation of the case resulted in a settlement of $1,100,000 from Wal-Mart, with $300,000 of the settlement being placed into an annuity that will guarantee of client a total payout over the course of her lifetime of $1,500,000.
