A 31 year old woman was driving her car eastbound on North Ave. in Lombard, IL when she was struck head-on by a drunk driver. She was then rear-ended by a semi-truck traveling in the same direction. Both impacts caused massive damage to her car. She suffered multiple fractures of her legs, pelvis and wrist, requiring multiple surgeries. She was hospitalized for nearly 5 months post accident. She has very significant difficulty walking today and has multiple scarring over most of her body. A Cook County, IL jury found both the drunk driver and semi-truck driver responsible. The jury awarded our client $6,521,000. In addition, a settlement was reached with the tavern where the drunk driver was drinking for another $60,000.

A 31 year old man was killed at a construction site when a crane struck a power line while lifting roof trusses to a building. The man was electrocuted and died. We sued the general contractor, the crane company, the subcontractor and the building supply company. After extensive litigation, the case settled against all parties for $3,400,000, securing the financial future of his surviving wife and child.

Medical malpractice settlement. A 55 year old man went to an emergency room, had a chest x-ray done. The emergency room physician misread the chest x-ray, told our client it was negative. The next day, the hospital had a radiologist re-read the x-ray films. He correctly found a 2-3 cm mass legion on the lung, but failed to check the x-ray for a discrepancy between his reading and the emergency room physician's reading, in violation of hospital policy. The family doctor got the results shortly thereafter and also failed to communicate the results to our client. Our client went about 12 months without knowing that he had lung cancer. At the time the mistakes occurred, he was stage IA with a 70 percent five year survival rate. By the time he was finally diagnosed 13 months later, he was stage IV and terminal. Our client died two years later.
Our firm, on behalf of the surviving family, sued the emergency room physician, the family doctor, the radiologist and the hospital where the chest x-ray took place. After extensive litigation, the case settled for $2,275,000, ensuring that his surviving spouse would be able to take care of herself for the rest of her life.

We obtained a jury verdict against the City of Chicago for the family of a 58 year old man that was killed, based upon the conduct of two Chicago police officers. The lawsuit was filed based upon the Illinois Domestic Violence Act, which requires police officers to use all reasonable means to prevent further domestic abuse when responding to a domestic violence call.
Two Chicago police officers responded to a 911 call from a south side home. They calmed down a hectic scene one time and left without making an arrest. Within 30 minutes, another 911 call came in from the same home. The same two police officers responded, finding the predominant aggressor to be intoxicated, out of control acting wildly, making stern gestures in the presence of the police. Despite this conduct, the police failed to make an arrest, took the aggressor outside in zero degree weather and left him on the sidewalk at three o'clock in the morning.
When the aggressor started to walk away before his ride arrived, the police chose to drive away. Within 6 minutes, another 911 came in from the home, asking for police assistance because the aggressor was breaking into the home. By the time the police arrived, the aggressor had broken into the home and murdered the 58 year old male owner of the home by striking him with a claw hammer and stabbing him.
The two week trial resulted in the jury deliberating for over ten hours over two days. The jury, in a unanimous verdict, found in favor of our client, the estate of the deceased man and against the City. The found the police officers acted in a willful and wanton fashion in their handling of the 911 calls and that that conduct was a proximate cause of the 58 year old man's death. They awarded $2,133,000 for his wrongful death.

A wealthy drunk driver struck a 3 yr old girl on a bicycle ridden by her mother, fracturing the child's leg and hip. The girl required three surgeries. The drunk driver was arrested and pled guilty to aggravated DUI. The personal injury case against the drunk driver settled for $1,630,000 dollars for the minor child. $1,100,000 was paid by the drunk drivers' insurance company and the remaining $500,000 of the settlement paid out of pocket by the drunk driver.

A 13 yr old boy was a passenger on a Chicago Transit Authority bus. The bus stopped at a CTA transfer station. The boy got off the bus and was pinned between two CTA buses, causing him to suffer a severe fracture of his femur. The case settled for $1,250,000. This settlement was the largest settlement of a fractured femur injury case involving a minor in the entire history of personal injury settlements in the state of Illinois.

A 34 year old woman was shopping in a Wal-Mart store when an employee of Wal-Mart caused some plastic waste baskets on an upper shelf to fall onto our client. As a result of the merchandise falling, our client suffered an elbow (ulnar nerve) injury which required two surgeries. She then developed Reflex Sympathetic Dystrophy (RSD) which has caused her to lose much of the function of her left arm. When we received the case from another law firm, they had a $200,000 offer to settle shortly before trial.
When our firm took over, we hired two prominent experts to discuss her future damages. This additional preparation of the case resulted in a settlement of $1,100,000 from Wal-Mart, with $300,000 of the settlement being placed into an annuity that will guarantee of client a total payout over the course of her lifetime of $1,500,000.

An 8 year old boy was going down an escalator in a suburban shopping mall when his left foot became entrapped between the step and the side of the escalator. This crushed his big toe on his left foot, resulting in its amputation. We were able to show that the step the boy was standing on had chipped prior to the accident, allowing extra space which caused his foot to become entrapped. The mall owner and escalator company settled for $450,000. A portion of that settlement money was placed into an annuity that will pay the boy over $1,000,000 over the course of his lifetime.

The CTA disputed that the bus was moving, but through diligent investigation, we discovered a videotape inside the bus that captured the whole event and confirmed that the bus was moving as our client exited it. The CTA settled for $775,000.

A 40 year old man was working on a construction site on a roof when the floor of the roof collapsed, send him falling to the ground. He suffered fractures to his jaw and arm. We sued the general contractor and a subcontractor for his serious personal injuries due to this construction accident. The insurance company offered nothing to settle the case before trial. The first day of trial, they offer $200,000. We put on our evidence, including our construction expert. By the fifth day of trial, the insurance company offered $750,000 to settle, which our client agreed to take to end the trial.

A family of five was struck by drunk driver, resulting in the death of three of the family members and injuries to three others. The drunk driver, a 19 year old girl, was convicted of DUI. She had a small $20,000 insurance policy. We sued the server of alcohol under the Illinois Dram Shop Act. Although the Dram Shop Act has relatively small caps on damages, we were able to maximize the recovery. We had to show that each of the three people who died did not do so instantly, otherwise we could not recover under the Dram Shop Act for injury. Through the use of accident reconstruction reports and expert testimony, we showed that each person who died lived for seconds after the accident before they died. Although the testimony was at times gruesome, it was necessary to prove our case. As a result, we were able to get the maximum $115,000 capped damages for the surviving family members for each person that died that day.

Our firm sued both drivers for negligence and the owner of one of the cars for negligent entrustment. Due to a dispute between the insurance companies, no offer to settle was made before trial. After 14 months, her problems we fixed. We were able to show that the surgeon who operated on her tried to blame his assistant, who denied that she placed any sutures that day. The jury, in this medical malpractice case, found against both doctors and awarded our client $505,641, including $300,000 for pain and suffering for one year.

City Ordinance Declared Unconstitutional
Our firm, with two other attorneys, represented Mark Weinberg, author of a book about Bill Wirtz, owner of the Chicago Blackhawks. Chicago police threatened our client with arrest on 3 nights. We filed a lawsuit in federal court alleging that our client's 1st amendment free speech rights were violated. The 7th Circuit Court of Appeals agreed, finding that our client's rights were violated and declared the City's peddler ordinance and licensing scheme were unconstitutional. The City petitioned to the U.S. Supreme Court, but that petition was denied.
