On Friday morning, a Chicago motorcyclist was struck and killed by a failing to yield CTA bus. The victim was identified as 31 year old Timothy Payne from the Roseland neighborhood of Chicago. He was taken to Northwestern Memorial Hospital where he died seven hours later from the injuries sustained in the failure to yield CTA bus accident. As an experienced Chicago personal injury lawyer, our firm has successfully settled thousands of personal injury cases that have resulted from failure to yield accidents. In addition, we have successfully litigated against the Chicago Transit Authority on serious injury and death cases.

A failure to yield accident occurs when a motor vehicle operator fails to give or yield to the car or party that has the right of way. There are several different types of failure to yield. In this case, it was a failure to yield to oncoming traffic when making a turn. According to police, the CTA bus driver was cited for failing to yield after striking Payne. The accident occurred in the South Loop on Michigan Ave. Timothy S. Payne, the victim, was traveling northbound on Michigan Avenue when a CTA bus hit him. The CTA bus was making a left hand turn when the collision occurred. The CTA bus driver was identified by authorities as 31-year-old Leonte Fraley. The CTA bus driver was cited for failure to yield right of way, according to police reports.

The Chicago accident lawyers at Nemeroff Law Offices are experienced in successfully winning failure to yield motor vehicle crashes. The key to success is to investigate the accident early, secure witness statements and scour the area where the accident occurred to locate video of the accident if it exists. In addition, many municipalities now have intersection cameras. A court ordered protective order and a timely subpoena to the city to preserve the evidence can make the difference in the success of the case. Hiring an experienced wrongful death lawyer is vital to winning the case and recovering money damages for the surviving beneficiaries of the deceased person.
